Terms of Service for Remember Journal

Welcome to Remember Journal. These Terms of Service ("Terms") govern your access to and use of the Remember Journal mobile application and website (collectively, the "Service").

The Service is operated by Category5 ("Category5", "we", "our", or "us").

By creating an account or using the Service, you agree to these Terms.

1. Eligibility

You must comply with all applicable laws when using the Service.

If you are under the age required by your local laws to enter into a binding agreement, you must use the Service with the permission of a parent or legal guardian.

2. Account Registration

To use Remember Journal, you must create an account.

You agree to:

  • Provide accurate account information
  • Maintain the security of your account credentials
  • Notify us immediately of unauthorized access

You are responsible for all activity that occurs under your account.

3. User Content

Remember Journal allows users to create and store personal content, including journal entries, photos, mood data, and media tracking.

You retain ownership of the content you create.

By using the Service, you grant Category5 a limited license to store, process, and transmit your content solely for the purpose of operating the Service.

We do not claim ownership of your journal entries or personal data.

4. End-to-End Encryption

Remember Journal offers optional end-to-end encryption (E2EE) for journal entries.

When E2EE is enabled:

  • Content is encrypted on your device
  • Category5 cannot read the encrypted journal content
  • Loss of encryption keys may result in permanent loss of access to encrypted data

Users are responsible for securely storing any encryption keys or recovery methods provided by the Service.

5. Acceptable Use

You agree not to use the Service to:

  • Violate any laws or regulations
  • Upload malicious software or harmful code
  • Attempt to gain unauthorized access to the Service
  • Interfere with the operation or security of the platform
  • Use the Service to harass or harm others

We reserve the right to suspend or terminate accounts that violate these rules.

6. Subscriptions and Payments

Some features of Remember Journal may require a paid subscription.

Subscriptions may be purchased through:

  • The Apple App Store
  • Google Play

Subscription terms may include:

  • Automatic renewal unless canceled
  • Billing through the applicable app store account
  • Pricing and billing terms displayed at the time of purchase

Refunds and billing issues are handled by the platform through which the purchase was made.

7. Account Termination

You may delete your account at any time through the application.

We reserve the right to suspend or terminate accounts that violate these Terms or pose a risk to the Service or other users.

Upon termination:

  • Access to the Service will end
  • Associated data may be deleted in accordance with our Privacy Policy

8. Service Availability

We strive to provide a reliable service but do not guarantee that the Service will always be available or uninterrupted.

We may modify, suspend, or discontinue parts of the Service at any time.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind.

To the fullest extent permitted by law, Category5 disclaims all warranties including:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement

10. Limitation of Liability

To the maximum extent permitted by law, Category5 will not be liable for:

  • Loss of data
  • Loss of profits
  • Indirect, incidental, or consequential damages

11. Governing Law

These Terms are governed by the laws of the State of North Carolina, United States, without regard to conflict-of-law principles.

Any legal disputes arising from these Terms will be resolved in the appropriate courts located within North Carolina.

12. Changes to These Terms

We may update these Terms from time to time.

If we make material changes, we will update the "Last Updated" date and may notify users through the Service.

Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
